Council of Commissioners
According to the Education Act for Cree, Inuit and Naskapi Native Persons, and General Bylaw 23.2, the Council of Commissioners operates with the following principles in mind.
First principle The Cree School Board is a public corporation holding all the powers necessary to exercise the functions assigned to it by the Act. Only the Board constitutes a legal person, and in no instances may a school under the jurisdiction of the Board be considered a legal entity distinct from the Cree School Board.
Second principles The Council of Commissioners is to be composed of the following members: one elected delegate from every Cree community one designated School Commissioner from the Cree Regional Authority.
The Council of Commissioners exercises all the functions and powers of the Cree School Board.
Every time a provision of the Act gives a power or duty to a school board, the legislator is understood to have granted that power or duty to the Council of Commissioners.
The responsibilities of the Council of Commissioners are enumerated mostly under sections 184, 255.2, 574, 575 of the Act.
Approves the Following
— Lease of immovable Board property for periods exceeding one month
— Lease or sale of Board property
— Purchases
— Leases of more than two years
— Contracts
— Capital projects
Composition
- Elected School Commissioners and one School Commissioner appointed by the Cree Regional Authority.
Cree Regional Authority
- Appoints one School Commissioner.
Duties
— Retains powers and prerogatives of the Cree School Board, which it may delegate
— Decides matters that have not been delegated
— Appoints the Chairman, Vice-Chairman and Executive Committee
— Appoints Director General and Deputy Director General
— Is the final decision maker in education and administration matters
— Approves annual budget of the Board, including capital plan
— Approves annual personnel plan of the Board.
Functions
— Manages and administers the affairs of the Board
— Oversees the creation of contracts for the Board
— Adopts a yearly personnel plan for the Board adopts a yearly budget for the Board
James Bay Beneficiaries
Are entitled to the services with other residents of the communities.
